South Carolina’s Base Load Review Act

South Carolina’s Base Load Review Act (2007) allowed utilities to recover costs of financing nuclear construction, provided it passes a prudency review of pre-construction costs. The Act is popularly blamed for saddling ratepayers with the costs of abandoned nuclear projects, and was repealed in 2018. In its repeal, the legislature dictated a stricter definition of “prudent” to the PSC.
