North Dakota Common Carrier Rules for CO2 Pipelines

The N.D.C.C. § 49-19-01 et seq. identifies CO2 pipelines as eligible for common carrier status. CO2 transport pipeline owners and operators may apply for a right-of-way to construct pipelines over public roads and highways. CO2 transport pipeline owners and operators have the right of eminent domain to condemn rights-of-way, easements, and property necessary to construct or maintain a pipeline.
