New Mexico Eminent Domain Rules for Carbon Dioxide Pipelines

In New Mexico, carbon dioxide pipeline project sponsors have eminent domain authority. N.M. Stat. Ann. § 70-3-5 lays out the legislature’s standard. A 1984 Attorney General Opinion (146) suggested that the legislature determined that eminent domain applies to carbon dioxide pipeline operators.
