New York rules for energy sales to adjacent properties

New York permits qualified renewable energy and cogeneration facilities to sell to customers located “at or near the project site.” Public Service Commission decisions have interpreted this grant to extend to as many as three large institutional customers located within half a mile of each other, but the full extent of this grant remains subject to regulatory uncertainty.
