New York’s Environmental Permitting In Disadvantaged Communities Legislation

In December 2022, New York State passed legislation to ensure that cumulative impacts are taken into consideration in the State’s environmental permitting processes when potentially polluting facilities seek permits in disadvantaged communities. It is the second such piece of legislation in the country, following New Jersey’s S232 (2020).
