MCLI Model Local Law for Data Centers - A Framework for Responsible Data Center Development

Developed in response to mayors’ requests, this resource outlines policy options for local governments seeking to ensure responsible data center development.

It establishes siting and permitting requirements, and allows data centers to be built only in designated zoning districts pursuant to special permit. Operational standards include that 100% of a data center's electricity come from renewable energy, storage, or distributed resources, along with caps on water use and noise, and limits on fossil fuel-fired backup generation. The model law also contains transparency and disclosure requirements, including prohibitions on nondisclosure agreement. Finally, the model local law requires a developer to enter into a community benefits agreement that meets minimum standards and covers measurable local benefits.

This model local law was developed primarily by MCLI, in partnership with Climate Mayors, the Sabin Center for Climate Change Law at Columbia Law School, and Climate XChange.
